In Compliance with sections 7, 8 and 9 of the Freedom of Information Act

Chapter 22:02 of the Laws of Trinidad and Tobago

 

In accordance with Sections 7, 8 and 9 of the Freedom of Information Act (FOIA) Chapter 22:02 of the Laws of the Republic of Trinidad and Tobago the South–West Regional Health Authority (SWRHA) is required by law to publish the following updated statements which list the documents and information generally available to the public.

 

The information herein contained is submitted for the period beginning May 1st, 2021and ending April 30th, 2022.

 

The Freedom of Information Act gives members of the public:

 

  1. A legal right for each person to access information held by the SWRHA.

 

  1. A legal right for each person to have official information relating to him/her amended where it is incomplete, incorrect or misleading.

 

  1. A legal right to obtain reasons for adverse decisions made regarding an applicant’s request for information under the FOIA.

 

  1. A legal right to complain to the Ombudsman and to apply to the High Court for Judicial Review to challenge adverse decisions made under the FOIA.

Section 7 (1) (a) (i)

Function and Structure of the South-West Regional Health Authority

 

The SWRHA is in the business of promoting wellness and providing compassionate, cost-effective customer-focused health care to the people of the South-West region of the Island of Trinidad within the guidelines of national policy.   

 

The SWRHA is a statutory body, which was established on May 20, 1994 in accordance with the Regional Health Authorities Act Chapter 29:05 (RHA Act) of the Laws of the Republic of Trinidad and Tobago. Pursuant to the RHA Act, SWRHA is managed by a Board of Directors and is required to exercise its powers and functions in accordance with such specific or general directions as may be given to it by the Minister of Health. The SWRHA currently employs over 5000 persons, making it one of the largest establishments in the nation encompassing a large cadre of both medical and non-medical staff with a wide range of capabilities.

The South-West region is a large and diverse geographic area, encompassing Counties Victoria, St. Patrick and Caroni South.  It extends from Freeport in the North-West to Tabaquite in the North-East and Icacos in the South-West to Moruga in the South-East, accounting for approximately one third of Trinidad’s land mass.

Effect of Functions of the SWRHA on Members of the Public:

The SWRHA is in the business of providing healthcare to the citizens of the South-West region. As such, its work impacts directly on persons living or working in the South-West region and by extension on every citizen of Trinidad and Tobago.

Section 7 (1) (a) (ii)

Categories of Documents in the possession of the SWRHA:

 

The SWRHA has the following categories of documents in its possession –

 

  • Files dealing with administrative support and general administrative documents for the operations of the SWRHA.
  • Personnel files, which detail all staff appointments, job applications, job descriptions and specifications, promotions, transfers, resignations, deaths, retirements, leave, vacations, etc.
  • Files dealing with the accounting and financial management functions of the SWRHA.
  • Financial records, such as, cheques, vouchers, receipts, journals.
  • Files dealing with matters relating to the procurement of supplies and equipment.
  • Contracts, agreements, leases, deeds and licenses.
  • News releases and speeches originating at the SWRHA.
  • Documents detailing the policies and procedure of the Human Resources, Finance, Procurement and Contracts and other Departments of the SWRHA.
  • Internal and external correspondence files.
  • Legislation and other legal instruments.
  • Legal opinions and related matters.
  • Files dealing with training and local and foreign technical co-operation.
  • Minutes and agendas of meetings.
  • Files dealing with circulars, memoranda, notices, bulletins, etc.
  • Reports – statistical (annual/monthly/quarterly), audit, consultants/technical, corporate, valuation, investigative, accident and incident, etc.

Procedure to be followed when accessing a document from the SWRHA:

 

How to Request Information:

 

  • General Procedure:

Our policy is to respond to all requests, both oral and written, for information. However, in order to exercise the rights given by the FOIA (for example, the right to challenge a decision if your request for information is refused), the request must be made in writing. The applicant must, therefore, complete a Request for Access to Official Documents Form available at the Release of Information Desk, Level 3 San Fernando Teaching Hospital, Chancery Lane San Fernando or from the Government FOIA Unit via its website at www.foia.gov.tt for information that is not readily available to members of the public. Proof of identification and other supporting documents will be required for your request to be processed.

 

  • Addressing Requests:

To facilitate prompt handling of your request, please address your request to the Senior Legal Officer/Designated Officer of the SWRHA (see Section 7 (1) (a) (vi)).

 

  • Details in the Request:

Applicants must provide details that will allow for ready identification and location of the documents (including medical records) that are being requested. If insufficient information is provided clarification will be sought from the applicant before the request is processed. If you are not sure how to write your request or what details to include, please communicate with the Senior Legal Officer/ Designated Officer of the SWRHA.

 

  • Requests not handled under the FOIA:

A request under the FOIA will not be processed to the extent that it asks for information, which is currently available to members of the public, either from this public authority or, for example, from brochures and pamphlets.

 

Responding to the Request

 

  • Retrieving Documents:

The SWRHA is required to furnish copies of documents only when they are in our possession.

 

Please note that some documents created prior to the commencement of the Freedom of Information Act 1999 may have already been destroyed. The granting of a request for such documents may therefore be impossible. Various laws, regulations and manuals specify the time periods for keeping records before they will be destroyed, for example, the Exchequer and Audit Act, Chapter 69:01.

 

  • Furnishing Documents:

An applicant is entitled to copies of information we have in our possession, custody or power. We are required to furnish only one copy of a document. If we cannot make a legible copy of a document to be released, we may not attempt to reconstruct it. Instead, we will furnish the best copy possible and note its quality in our reply. Please note that we are not compelled to do the following:

 

  1. Create new documents, for example, write a new program so that a computer will print the information in the format you prefer.

 

  1. Perform research for you.

 

 

Time Limits:

 

  • General:

The FOIA sets certain time limits for us to decide whether to disclose the documents you have requested. If we fail to meet the deadlines, the FOIA gives you the right to proceed as if your request has been denied. We will try diligently to comply with the time limit, we will acknowledge your request and advise you of its status. Since there is a possibility that requests may be misaddressed or misrouted, you may wish to call or write to confirm that we have received the request and to ascertain its status.

 

  • Time Allowed:

We will determine whether to grant your request for access to information as soon as practicable but not later than 30 calendar days after the request is submitted to the SWRHA, as required by Section 15 of the FOIA. However, your request will only be registered as having been submitted to the SWRHA on the day that your Request for Access to Official Documents Form is first stamped as having been received by an official of the SWRHA. If a decision is taken to grant access to the information requested, you will be permitted to inspect the documents or be provided with copies, if you so request.

Designated Reading Room Facilities:

 

Certain information may be accessed by members of the public via our website at www.swrha.co.tt or in our Designated Reading Room. You may make general enquires through the Administrative Assistant to the Senior Legal Office at 225-1815. The Designated Reading Room at the SWRHA is located at Level 8, San Fernando Teaching Hospital, Chancery Lane, San Fernando. The Designated Reading Room is open to the public by appointment Mondays to Fridays from 9:00 a.m. to 2:00 p.m. Members of the public are required to comply with security, OSH and other related guidelines for utilizing the Designated Reading Room as it pertains to access control (the signing In and Out of Visitors Registers) as well as adherence to fire alarms/evacuation directives.

  • Provision of certain documents may be subject to a charge to cover administrative costs.
  • No smoking, eating or drinking is allowed in the Reading Room.
  • Mobile devices are not allowed in the Reading Room.
  • Photography & videography are allowed in the Reading Room.
  • Access for use of the Reading Rooms is by appointment only. Persons are required to liaise with the Officer to schedule an appointment (see Section 7 (1) (a) (vi)).
